The Directorate of Investment and Company Administration (DICA)

DICA Background

As part of its effort to establish a market oriented economic system in Myanmar, the Directorate of Investment and Company,Administration (DICA) was formed under the Ministry of National Planning and Economic Development on October 13, 1993.

As the primary interfacebetween businesses and the government, DICA is mandated to promote private sector development and to boost domestic and foreign investment by creating a conducive investment climate. DICA is taking several functions

DICA has several functions, as:

  • as a regulator on investment and companies
  • as a company registrar
  • as an investment promotion agency
  • and as the Secretariat of MIC.

Furthermore , DICA is also responsible for drafting, negotiating and approving bilateral Investment Promotion and Protection Agreements and serves as a focal department for all ASEAN investment related affairs (e.g. ASEAN Comprehensive Investment Agreement, bilateral ASEAN Investment Agreements).

Myanmar Companies Law was come into force on 1st August, 2018 by the announcement No. 48/2018 of President Office, and the MyCO Electronic Registry System was launched on 1st August 2018. Regarding the FDI Actual Inflow statistics with to know the public has been added.

Responsibilities

  • Administering and improving staff capacity - and preparing, amending and getting approval for organisational chart.
  • Responsible for staff appointments, increments, promotions, transfers, investigations, demotions, getting actions, dismissals, and pensions.
  • Administering leave allowances, service periods, compensation and issuing the Last Payment Certificate.
  • Maintaining the following staff documents: Service Book, Staff Person Card, Personal File, Long Roll, and Leave Register.
  • Responsible for government gazette files and internal directives files, keeping records for pension date for all staff, and awards given by the State.
  • ဝ Administering the requirements of stationery by the departments, and processing inward/outward letters.
  • Maintenance of the office building and staff apartments.
  • Purchasing, systematic using, maintaining, recording, and reselling office equipment.
  • Purchasing, managing usage, maintaining, recording, reselling auto mobiles for office use and recruiting drivers.
  • Purchasing, managing usage, maintaining, recording, reselling office appliances and office furniture.
  • Administering the vehicles for preparing, maintaining, submitting allotment and coordinating to CESID department.
  • Recruitment for the administration of sanitation and cleaning.
  • Recruitment of building security workers.
  • Preparing budgets to be in line with the directives of the concerned department.
  • Collecting fees for company registration and other activities.
  • Preparing monthly financial reports.
  • Administration and processing of department expenses.
  • Paying staff salaries, travelling allowances, and overtime allowances.
  • Processing, recording and collecting data, and information of the different departments.
  • Processing and maintaining computer hardware, software and other related accessories.
  • Supporting technology to the required departments for computerisation.
Responsibilities of Company Section (Foreign)
  • Processing incoming application letters from the public.
  • Processing the incorporation of foreign companies/branch associations and special companies under 1950 Special Companies Act.
  • Processing Form VI, XXVI, E, XVIII, Address Change, Share Transfer, Change of Business Objectives, etc.
  • Processing the renewal of foreign companies/branch associations and special companies under 1950 Special Companies Act.
  • Processing the assignment of audit in special companies.
  • Processing recommendations to the Immigration Office for visa extensions of foreign employees in foreign Companies.
  • Processing the liquidation of foreign companies/branch.
Responsibilities of Company Section (Myanmar)
  • Processing incoming application letters from the public.
  • Processing the incorporation of Myanmar companies, foreign companies/branch associations and special companies under 1950 Special Companies Act.
  • Processing Form VI, XXVI, E, XVIII, Address Change, Share Transfer, Change of Business Objectives, etc.
  • Processing the renewal of Myanmar companies, foreign companies/branch associations and special companies under 1950 Special Companies Act.
  • Processing the assignment of audit in special companies.
  • Processing recommendations to the Immigration Office for visa extensions of foreign employees in Myanmar companies and foreign Companies.
  • Processing the liquidation of Myanmar companies, and foreign companies/branch.
  • Conducting research on local and international policy affairs, and local and international current affairs.
  • Facilitation for staff to attend local and foreign training courses to strengthen the human resource development of DICA.
  • Arranging for staff to give lectures when invited by other departments and organisations.
  • Administering arrangements for sending staff to attend local and foreign seminars, meetings and study tours.
  • Performing duties as assigned by superiors.
  • Issuing MIC Permits for the agriculture, forest, livestock, fisheries, and foodstuff sectors - under the foreign and Myanmar Citizen’s Investment Law.
  • Explaining rules, regulations, procedures, and sharing information on investment opportunities with local and foreign investors and consultants.
  • Making checklists to evaluate proposals - such as financial justification and machinery. Submitting these to the Proposal Assessment Team and requesting the State or Regional government and relevant ministries’ comments at the same time.
  • Issuing the applicant with a requirement letter showing the policies and economic justifications/changes required by the Proposal Assessment Team.
  • Analysis of the economic justification re-submitted by the company.
  • Preparing letters for the applicant when it is necessary to amend their proposal in accordance with the recommendation of relevant ministries.
  • Submit to MIC Meeting proposals that are completely analysed.
  • Issue MIC Permit for proposals approved by the MIC.
  • Media transparency for investment information related to the MIC.
  • Amend permits for promoter’s name changes, increased investment amounts, company’s address changes, extended and amended investment place,and business name changes and etc.
  • Carry out the development of Special Economic Zones in accordance with law, rules and regulations.
  • Support the Myanmar Special Economic Zone Central Working Body.
  • Submit weekly reports on the implementation of Special Economic Zones to the President's Office.
  • Issuing MIC Permits for the garment sector, and small, middle, and heavy industry sectors under the foreign and Myanmar Citizen’s Investment Law.
  • Explaining rules, regulations, procedures, and sharing information on investment opportunities with local and foreign investors and consultants.
  • Making checklists to evaluate proposals - such as financial justification and machinery. Submitting these to the Proposal Assessment Team and requesting the State or Regional government and relevant ministries’ comments at the same time.
  • Issuing the applicant with a requirement letter showing the policies and economic justifications/changes required by the Proposal Assessment Team.

  • Obtaining import licenses for raw materials and machinery - which are required for business after issuing an MIC permit.
  • Stipulating the rights of the business (such as tax exemption and relief), as approved in MIC meetings.
  • Performing activities related to the appointment of foreign experts, stay permits/visa extensions/multi-entry visas for businesses with a MIC permit.
  • Monitoring reports, submissions and tax payments.
  • Collecting monthly data on investment flows for senior officials.
  • Checking submissions for increases investment amounts, and requests for imported machinery after construction period for approval at MIC meetings.
  • Monitor businesses.
  • Conducting workshops, seminars and meetings - in collaboration with local and foreign organisations involved in investment promotion.
  • Coordinating and cooperating with foreign and local organisations for investment promotion affairs.
  • Uploading updated investment data, information, news, procedures and rules and regulations on DICA's website.
  • Publication of Investment Guide Books.
  • Arranging courtesy calls with MIC members.
  • Outbound investment promotion.
  • Performing external and internal investment promotion activities.
  • Collecting company registration and investment data for planning laws and regulations, and policy-making.
  • Producing various investment reports for internal government institutions, and the Union Minister's Office - for the purpose of the transparency.
  • Obtaining technical assistance from the Central Bank of Myanmar, ASEAN Secretariat Office, International Monetary Fund (IMF), and other international organisations.
  • Supporting the Investment Statistics National Level Working Group.
  • Encouraging the settlement and expansion of a dynamic investment network.
  • Managing and monitoring the accurate acquisition of foreign and local investment statistics.
  • Supporting investment promotion by establishing investment network infrastructure.
  • Maintaining the security of computerised data and information.
  • Establishing a plan to increase the use of computers throughout DICA.
  • Be responsible and accountable concerning the use of information and technology.
  • Implementing e-Government projects with the government’s guidance.
  • Research and analysis of investment flows based on accurate statistics.
  • Reviewing, revising and amending existing laws with respect to DICA - such as the Foreign Investment Law, Myanmar Citizens Investment Law, Myanmar Companies Act, State-Owned Economic Enterprises Law and Partnership Act.
  • Drafting rules and procedures, as well as issuing notifications.
  • Arranging seminars, workshops, meetings and negotiations which are to be held locally or abroad.
  • Carrying out policy matters pertinent to the MIC.
  • Explaining investment opportunities when and if necessary.
  • Scrutinising Permits (draft) and Decisions (draft) of foreign investment and Myanmar citizen investment and Notifications (draft).
  • Providing comments on matters requested from Investment Divisions 1, 2, 3, and 4 - and the company registration office.
  • Providing legal comments on laws and regulations, as asked for from ministries.
  • Attending trainings, workshops, seminars, MIC meetings, Proposal Assessment Team Meetings and other related departmental meetings.
  • Answering the queries of Hluttaw’s representatives with regard to investment matters.
  • Taking minutes of MIC meetings and Proposal Assessment Team meetings.
  • Holding and attending ASEAN meetings, and performing ASEAN investment matters.
  • Scrutinising, drafting, negotiating and approving documents relating to bilateral Investment Promoting and Protection Agreement.
  • Arranging the running of local and foreign investment training in the States and Divisions.
  • Studying and researching international best practices for facilitation and promotion of investment.
  • Doing investment-related research.
  • Answering queries and giving legal advice to investors.
  • Preparing talking points for the Union Minister's and Director General’s foreign trips and discussion topics.
  • Sending weekly report of experts to Minister’s Office and preparing departmental reports monthly.
  • Anti-corruption activities.
  • Performing duties and responsibilities assigned from supervisors.
  • Providing information relating to investment opportunities and the economic environment to foreign and local entrepreneurs who have are interested in doing business in Myanmar.
  • Issuing export/import licenses for investment projects(Yangon Region).
  • Scrutinising, consulting and processing tax-related matters.
  • Providing services for administrative work on customs clearance.
  • Coordinating with relevant departments on electricity requirements.
  • Coordinating with relevant departments on the employment permission for the recruitment of experts and technicians from abroad.
  • Providing services for getting visas, stay permits and visa extensions.
  • Scrutinising and issuing investment-related licenses and permits which are need to apply to relevant departments.
